TERMS OF SERVICE

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and Hammock Creative ("Company," "we," "us," or "our"), located at 2976 Grey Squirrel Ct, Marietta, GA 30067. By accessing our website at www.hammock-creative.com or engaging our services, you agree to be bound by these Terms.

2. Services Provided

Hammock Creative offers marketing and consulting services for short-term rental businesses, including but not limited to:

  • Website design and development

  • Social media management

  • Email marketing campaigns

  • Paid advertising management (Google Ads, Meta Ads, etc.)

  • Technology consulting and optimization

  • General marketing strategy and consulting

The specific scope of services, deliverables, timelines, and fees for each engagement will be outlined in a separate written agreement, proposal, or statement of work ("SOW") signed by both parties.

3. Client Responsibilities

As a Client, you agree to:

  • Provide accurate, complete, and timely information necessary for us to perform services

  • Obtain and maintain all necessary rights, licenses, and permissions for materials you provide to us

  • Designate an authorized point of contact for approvals and communications

  • Provide timely feedback and approvals as required to keep projects on schedule

  • Pay all fees in accordance with the agreed payment schedule

4. Payment Terms

Fees for services are as specified in the applicable SOW or proposal. Unless otherwise agreed in writing:

  • Invoices are due within 15 days of receipt

  • A deposit may be required before work commences

  • Late payments may be subject to a 1.5% monthly interest charge

  • We reserve the right to suspend services for accounts more than 30 days past due

All fees are non-refundable except as expressly stated in a signed agreement or required by law.

5. Intellectual Property

Upon receipt of full payment for a project, and unless otherwise specified in a signed agreement:

  • Client-provided materials remain the property of the Client.

  • Final deliverables created specifically for Client become Client property upon full payment.

  • Hammock Creative retains ownership of all underlying tools, frameworks, templates, methodologies, and pre-existing intellectual property used in delivering services.

  • Hammock Creative reserves the right to display completed work in its portfolio unless Client requests otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement, including business strategies, financial information, customer data, and trade secrets. This obligation survives termination of the engagement.

7. Limitation of Liability

To the fullest extent permitted by law, Hammock Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities, arising from or related to our services, even if advised of the possibility of such damages.

Our total liability for any claim arising from services shall not exceed the total fees paid by Client for the specific services giving rise to the claim in the three (3) months preceding the claim.

8. No Guarantee of Results

Marketing results vary based on many factors outside our control, including platform algorithm changes, market conditions, and competition. We do not guarantee specific outcomes such as revenue growth, booking rates, search rankings, or advertising performance. We commit to delivering professional services with reasonable care and skill.

9. Termination

Either party may terminate an engagement with 30 days written notice. Upon termination:

  • Client is responsible for payment for all services rendered through the termination date

  • We will deliver any completed work product paid for in full

  • Confidentiality obligations survive termination

We reserve the right to terminate immediately if Client engages in fraudulent, illegal, or abusive conduct.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Cobb County, Georgia.

11. Changes to Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on our Site with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.

12. Entire Agreement

These Terms, together with any signed SOW or service agreement, constitute the entire agreement between the parties regarding its subject matter and supersede all prior discussions, representations, or agreements.
